ARGENTINA - Government Requesting
Discretionary Documents for Article 29 E Work Authorization Applications

Direccion Nacional de Migraciones (DNM), the
National Immigration Directorate in Argentina, has changed its practices for
processing Transitory ("Article 29 E") work authorization applications. While
formal requirements for Article 29 E work authorization have not changed, DNM is
exercising its discretion to request documentation above and beyond what is
formally required at the time of application review. In nearly all cases, DNM is
requesting a more specific support letter from the employer with details about
the assignee's duties abroad and proposed duties in Argentina, and a statement
that no Argentine worker is able to perform the duties in Argentina. Applicants
are encouraged to provide such a letter up-front to avoid processing delays.
Additional discretionary document requests vary across cases.
About Article 29 E Work Authorization
Article 29 E work authorization is for short-term, transitory work engagements.
The activities to be performed should be artistic, religious, or cultural in
nature, or professional and technical involving specialized skills. The
activities must be required by a person or company established in Argentina. The
authorization, issued by either an Argentine consular post or by the DNM in
Argentina after the employee enters Argentina as a visitor, is valid for an
initial period of 15 days and can be renewed through DNM for an additional 15
days once per stay.
